These Terms of Service (“Terms”) govern your access to and use of WebList Directory (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are an EEA/UK consumer, your mandatory statutory rights remain unaffected.
1) Who we are
WebList Directory is a product search and listings directory. We aggregate and present information from merchants and third-party sources. You can contact us at info@weblist.directory.
2) Using the Service & Acceptance
- You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
- By using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- We may update the Service and these Terms from time to time (see “Changes”).
3) Accounts
- You are responsible for your account activity and for keeping your credentials secure.
- We may suspend or terminate accounts that violate these Terms or applicable laws.
4) Listings, Prices & Availability
- Product information, prices, availability, shipping costs and taxes are provided by merchants or public sources and may change without notice.
- We try to keep information accurate but do not guarantee correctness or availability. Always verify on the merchant’s website before purchasing.
- We may use affiliate links or earn commissions from qualifying purchases. This does not affect the price you pay.
5) Additional terms for merchants
- Merchants must provide accurate, non-misleading information and keep it up to date.
- By submitting content (text, images, logos, feeds), you grant us a worldwide, non-exclusive, royalty-free license to host, cache, display and promote it in connection with the Service.
- We may refuse, de-rank, annotate, label as “sponsored” or remove listings at our discretion, including for quality, safety or legal reasons.
6) Your content & license
- When you post reviews, comments or other content, you retain your rights, but you grant us a license to display and distribute that content via the Service and our channels.
- Do not submit content that is unlawful, infringing, deceptive, defamatory, contains malware, or violates others’ rights.
7) Prohibited activities
- Scraping, crawling or bulk data extraction without our prior written consent.
- Reverse engineering or interfering with security or access controls.
- Using the Service to promote illegal products, hate, or harassment.
8) Intellectual Property
The Service and its content (excluding user submissions and third-party trademarks) are owned by us or our licensors and protected by intellectual-property laws. All trademarks belong to their respective owners.
9) Notice & takedown (DMCA/EEA)
If you believe content on the Service infringes your rights, email info@weblist.directory with subject [Takedown] and include: URLs, description of the work, your contact details, and a good-faith statement of ownership. We may forward your notice to the uploader/merchant.
10) Third-party links
Links to third-party websites are provided for convenience. We do not control or endorse those sites and are not responsible for their content, policies or practices.
11) Privacy
Our Privacy Policy explains how we collect and use personal data. By using the Service, you acknowledge our privacy practices.
12) Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that prices, availability or content are accurate, complete, or error-free.
13) Limitation of liability
To the fullest extent permitted by law, WebList Directory and its affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
If we are found liable, our aggregate liability will be limited to the greater of €50 or the amounts (if any) you paid to us for the Service in the 12 months preceding the claim.
14) Indemnification
You agree to defend, indemnify and hold harmless WebList Directory from any claims, damages, liabilities, costs and expenses arising from your use of the Service or your violation of these Terms or applicable law.
15) Suspension & termination
We may suspend or terminate the Service or your access at any time, with or without notice, if we reasonably believe you breached these Terms, created risk, or for maintenance and operational reasons.
16) Governing law & disputes
Unless mandatory local law provides otherwise, these Terms are governed by the laws of The Netherlands. Courts of Amsterdam have exclusive jurisdiction. If you are a consumer in the EEA/UK, you may have the right to bring disputes in your country of residence.
17) Changes to these Terms
We may modify these Terms. Material changes will be indicated by updating the “Effective” date above and, where appropriate, by additional notice. Your continued use of the Service after changes becomes effective constitutes acceptance.
18) Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent.
- Entire agreement: These Terms constitute the entire agreement between you and us regarding the Service.
